Ce premier tome I du volume 77 comprend les travaux préparatoires de la session de l’Institut de Droit international qui se tiendra en septembre 2017 à Hyderabad sous la présidence du Professeur Pemmaraju Sreenivasa RAO.

Le volume 77-I de l’Annuaire de l’Institut de Droit renoue ainsi avec la publication annuelle de cet ouvrage, interrompue en 2007. En effet, la tradition veut que le volume de l’année correspondant à l’organisation de la session de l’Institut contienne les travaux préparatoires qui feront l’objet de discussions durant la session, et que le volume suivant reflète les travaux, discussions et résolutions adoptés durant la session en question. Entre 2007 et 2015, les volumes de l’Annuaire contenaient aussi bien les travaux préparatoires que les travaux des sessions.

Le présent volume contient ainsi les travaux préparatoires des commissions suivantes : Commission n° 3 « Mesures provisoires » (rapporteur Lord Collins of Mapesbury), Commission n° 4 « Droits de l’homme et droit international privé » (rapporteur M. Jürgen Basedow), Commission n° 12 « Le contrôle juridictionnel des résolutions du Conseil de Sécurité » (rapporteur M. Rüdiger Wolfrum) et Commission n° 16 « Migrations de masse » (rapporteur M. Maurice Kamto). Les travaux préparatoires comprennent les rapports préparés par chacun des rapporteurs, les échanges de correspondance au sein des commissions et les projets de résolution qui seront soumis à la considération des membres en séances plénières. En fonction de l’état d’avancement des travaux  et de l’actualité des problématiques abordées, le Bureau de l’Institut décide de l’organisation des travaux de la session et donc de l’ordre de discussion des rapports. La prochaine session, la 78^ème depuis la fondation de l’Institut, aura lieu à Hyderabad du 3 au 10 septembre 2017.

Durant la prochaine session, l’Institut discutera également un projet de révision de son Règlement dans le but d’améliorer son fonctionnement et d’adapter ce texte aux exigences du 21^e siècle. Le projet de révision qui intègre ce volume est le fruit du travail d’une commission ad hoc sous la présidence de M. Gilbert Guillaume. Le présent volume comprend également le premier rapport d’une commission créée récemment sur l’histoire de l’Institut, présidée par M. Jean Salmon, dans lequel sont expliqués les travaux futurs de cette commission.

Le volume comprend les notices nécrologiques des membres décédés depuis la précedente cession. 

Foreword

The volume 77-I of the Yearbook of the Institute of International Law returning to its annual publication, which was interrupted in 2007. In fact, the tradition is that the volume corresponding to the year of the organisation of the session of the Institute contains the preparatory works which will be discussed during the session, and that the following volume reflects those works, discussions and resolutions adopted during the session concerned. Between 2007 and 2015 the volumes of the Yearbook included both the preparatory works and the works of the sessions.

The present volume thus contains the preparatory works of the following commissions: Third Commission: “Provisional Measures” (rapporteur Lord Collins of Mapesbury); Fourth Commission: “Human Rights and Private International Law” (rapporteur Mr Jürgen Basedow); Twelfth Commission: “Judicial of Security Council Decisions” (rapporteur Mr Rüdiger Wolfrum); and the Sixteenth Commission: “Mass Migrations” (rapporteur Mr Maurice Kamto). These preparatory works include the reports prepared by each of the rapporteurs, the exchanges within the respective commissions and the draft resolutions that will be submitted for the consideration of the plenary. The Bureau of the Institute decides on the organisation of the works of the session and thus the order of the deliberations of the reports in light of the work progress and the actuality of the issues addressed. The next session, the 78th since the foundation of the Institute, will take place in Hyderabad, from 3 through 10 September 2017.

During the next session, the Institute shall also discuss a draft revision of its Rules with the goal to improve the functioning of the Institute and adapting the Rules to the demands of the 21^st century. The draft revision integrated in this volume is the result of the work of an ad hoc Commission under the presidency of Mr Gilbert Guillaume. The present volume equally includes a first report by a recently created Commission on the History of the Institute, presided by Mr Jean Salmon, in which the future activities of this commission are explained.
